State: AK AL AR AZ CA CO CT DC DE FL GA HI IA ID IL IN KS KY LA MA MD ME MI MN MO MS MT NC ND NE NH NJ NM NV NY OH OK OR PA RI SC SD TN TX UT VA VT WA WI WV WYHazardous substances are (1) any substance designated pursuant to Section 311(b)(2)(A) of the Clean Water Act (40 CFR 117); (2) any element, compound, mixture solution, or substance designated pursuant to Section 102 of the Comprehensive Environmental Response, Compensation, and Liability Act (40 CFR 302); (3) any hazardous wastes having the characteristics identified under or listed pursuant to Section 3001 of the Resource Conservation and Recovery Act (40 CFR 261); (4) any toxic pollutant listed under Section 307(a) of the Clean Water Act (40 CFR 129.4); (5) any hazardous air pollutant listed under Section 112 of the Clean Air Act (40 CFR 61.01); and (6) any imminently hazardous chemical substance or mixture with respect to which the EPA Administrator has taken action pursuant to Section 7 of the Toxic Substances Control Act (no regulations presently exist, and no substance or mixture has been listed). Note: The term "hazardous substance" does not include petroleum, including crude oil or any fraction there of, which is not otherwise specifically listed or designated as a hazardous substance under (1) through (4) above, and the term does not include natural gas, natural gas liquids, liquefied natural gas, or synthetic gas usable for fuel (or mixtures of natural gas and such synthetic gas).
